Separate four problems before choosing a remedy
First, the communication may come from an impersonator with no official authority. Second, it may be a genuine officer’s lawful request that the business finds uncomfortable. Third, there may be evidence of an improper demand or excess by an official. Fourth, the underlying complaint itself may be alleged to be deliberately false.
Each problem needs different evidence and a different channel. A general accusation of “harassment” can conceal those distinctions and weaken a legitimate grievance. Verify identity, obtain the actual documents and prepare a precise chronology before making public allegations.
NCCIA has lawful PECA functions. The existence of those functions does not authorise misconduct, but dissatisfaction with an inquiry does not establish misconduct either. [1]
A failed complaint is not automatically a malicious complaint
An allegation may be mistaken, insufficiently supported or ultimately rejected without proving that the complainant knowingly fabricated it. Any proposed counter-proceeding must be assessed against the elements of the relevant offence or civil claim and the required evidence.
Preserve the original complaint, the disputed statement, records showing its inaccuracy and any evidence of knowledge or improper purpose. Avoid assuming that acquittal, bail or closure alone answers every element of a separate claim. Bail in particular is not a final finding that the complainant lied. [3]
Do not threaten a genuine complainant with litigation merely to stop cooperation with an investigation. A lawful response should correct facts and protect rights without intimidation.
Preserve evidence of an improper demand
Retain messages, call details, payment instructions and relevant documents in their original form where possible. Record dates, participants and exactly what was said, distinguishing direct knowledge from what someone else reported. Keep lawful copies securely.
Do not offer a bribe, arrange an amateur sting or publish personal information as leverage. The legality and safety of recording or investigative steps require specific advice. A demand for money into a personal account should be independently assessed; it is not made legitimate by being labelled a “case expense”.
If a payment has already been made, preserve the transaction and explain it honestly to counsel. Concealment can prevent an accurate assessment of the available reporting route and the business’s own position.
Use agency representation for a defined administrative grievance
A written representation can identify the officer or office, case reference, specific action, supporting records and the correction requested. Keep the tone factual and avoid unsupported allegations against an entire institution.
Possible requests may include verification of a communication, correction of a record, clarification of scope or consideration of documented conduct by the appropriate supervisory office. An administrative representation does not itself stay criminal proceedings, extend a deadline or cancel a lawful order.
Where an urgent liberty or court-order issue exists, do not rely solely on correspondence to the agency. Obtain advice on the competent judicial remedy and applicable time limits. [2] [3]
Understand the Federal Ombudsman’s limits
The Wafaqi Mohtasib deals with qualifying maladministration complaints concerning federal agencies within its statutory jurisdiction. Its own guidance identifies exclusions, including sub judice matters. It should not be advertised as an alternative criminal court or a guaranteed route to stopping an FIR. [4]
Before filing, check whether the grievance falls within jurisdiction, whether related proceedings are pending and what supporting material is required. A complaint about administrative handling is different from asking the Ombudsman to decide guilt, grant bail or reverse a judicial order.
Selecting the wrong forum can waste time and create inconsistent accounts. Prepare one accurate chronology and adapt the requested relief to the authority that can lawfully grant it.
Judicial remedies should address the immediate legal wrong
Unlawful custody, a disputed search, seizure or an action beyond authority may require a specific court procedure. Article 199 and criminal-procedure routes have different conditions. Current forum allocation, alternative remedies and the actual case stage must be examined. [2] [3]
A hypothetical business receiving repeated unofficial payment demands during an inquiry should preserve the demand and seek advice on reporting it, while continuing to comply with valid investigative obligations. Reporting alleged misconduct does not automatically suspend those obligations.
Similarly, a challenge to an inaccurate allegation should not be used to destroy relevant campaign records. The business’s strongest position is a truthful response and reliable evidence of the specific wrongdoing it asserts.
Communicate carefully with employees and clients
Provide verified operational information without naming people as criminals before lawful determination. Protect customer and employee data and avoid sharing unredacted case documents in public groups. Reputational frustration is understandable, but an inaccurate public accusation can create additional legal exposure.
Maintain a matter log showing the grievance, authority approached, documents submitted, response and next deadline. Keep administrative complaints, criminal defence and employment issues separate enough to prevent confusion, but coordinated through a consistent factual record.
Accountability works best when the complaint is specific, evidenced and directed to the proper forum. The aim is a lawful correction or investigation of misconduct, not retaliation against everyone involved in the original inquiry.
Legal assistance for this issue
Legal Bridge LLP can assess a documented allegation of misconduct or false complaint and identify an appropriate Pakistan-law route. The merits, jurisdiction and underlying investigation must be examined separately.
