Why identifying the power comes before arguing about the agency
“NCCIA has contacted us” is not enough information to choose a response. A preservation notice, an inquiry request, a search warrant and an arrest involve different legal questions. The business should identify the document, issuing officer, case reference, requested action and deadline before deciding what to produce or challenge.
Section 29 establishes NCCIA’s PECA investigation framework, including inquiry, investigation and prosecution functions. Section 30 addresses authorised officers and investigation arrangements. The 2025 changes transferred the former FIA Cyber Crime Wing’s relevant functions and cases; they did not abolish FIA as an institution. [1]
A business should therefore avoid relying on old web articles that assume every cybercrime matter still follows the earlier institutional structure. Equally, an agency name does not eliminate the conditions attached to a particular power.
Territorial and cross-border jurisdiction
PECA’s application includes persons and conduct connected to Pakistan in the ways described in section 1, including specified effects on persons, property, information systems or data located in Pakistan. The precise jurisdictional connection must be established from the allegation. It is inaccurate to describe NCCIA as having unrestricted worldwide jurisdiction over every foreign dispute. [1]
A Pakistani team allegedly deceiving overseas customers may create a Pakistan-connected investigation even when the complainants are abroad. Obtaining evidence overseas and enforcing orders abroad raise additional cooperation questions; they do not disappear because an email or server crosses a border.
Section 42 addresses international cooperation. Businesses should distinguish the agency’s domestic authority from the separate procedures required to obtain foreign material. An overseas client’s contractual instruction is not a defence to conduct prohibited by Pakistani law.
Preservation is not the same as a general demand for everything
Section 31 concerns expedited preservation and acquisition of specified data. Its conditions address material reasonably needed for an investigation and the risk that it may be modified, lost or otherwise become inaccessible. A preservation direction can specify a period up to 90 days, with the statutory court-related procedures applying. Acquisition under the section must be notified to the court within the prescribed 24-hour period. [1]
The practical question for a business is what data must remain intact and who controls it. A legal hold may need to reach email retention, CRM logs, call recordings or cloud backups. It should be scoped to the notice and relevant facts, not implemented as indiscriminate collection of every employee’s private information.
Section 32 concerns traffic-data obligations of service providers. It should not be casually restated as a rule that every call centre must retain every audio recording for one year. Definitions, data type and the organisation’s role matter.
Search warrants, content data and execution safeguards
Section 33 provides the search-and-seizure warrant framework. Its limited warrantless exception concerns section 10 and specified urgency, officer and notification conditions. An ordinary allegation of fraud does not, by itself, satisfy that particular exception. Other claimed legal powers must still be examined on their own terms. [1]
Section 34 is different: it concerns a warrant for disclosure of content data. Confusing it with an arrest provision can lead to a materially wrong response. Section 35 then regulates the execution of powers, including proportionality, data integrity, confidentiality and avoiding unnecessary disruption of legitimate business.
Section 36 deals with seizure documentation and forensic images. Read these provisions together. The existence of a warrant does not make every implementation choice automatically proportionate, and the safeguards do not make a business immune from a justified search.
Arrest and prosecution require their own analysis
NCCIA’s investigative officers have the statutory relationship to police powers described in section 29, with the Code of Criminal Procedure applying insofar as it is consistent with PECA. Arrest questions therefore require attention to the alleged offence, its classification, the available material and applicable procedure. They cannot be answered by citing section 34. [1] [2]
A complaint is not a conviction. A registered FIR is not a finding of guilt. Equally, the business should not assume that no action is possible until every trial-level fact has been proved. Investigation, arrest, remand, bail and trial have distinct purposes and legal standards.
Where someone is detained, counsel should identify custody location, the alleged sections and the production or remand position promptly. The legal team should receive actual documents, not only a manager’s summary of what an officer said.
Worked example: a narrowly framed notice
Imagine that a notice identifies one campaign, a defined date range and the client account used for disputed transactions. The company should preserve the relevant records and examine the requested production mechanism. It should identify whether a service provider or another corporate entity controls part of the material.
A useful response explains the company’s role, produces authentic material through the proper process and records any legitimate issue of scope, privilege, confidentiality or technical access. Simply responding “we are PSEB registered” does not address the investigation. Handing over unrelated customer databases without considering scope is not a substitute for cooperation either. [1]
This example illustrates a response method, not a prediction about any actual notice.
Build an authority-and-response record
For each official interaction, maintain a dated record of the officer’s verified identity, the legal document, the relevant sections, the data or premises concerned, the response deadline and what was actually provided. Keep the response factual and consistent with preserved records.
Where an action appears unlawful, seek a precise remedy directed at that action. A request to protect unrelated systems or document a seizure is different from asking a court to stop every investigation. The distinction makes legal submissions clearer and helps maintain cooperation without surrendering legitimate objections. [1] [3]
Legal assistance for this issue
Legal Bridge LLP can assess the Pakistan-law basis and scope of an NCCIA notice or investigative action, organise a documented response and consider the appropriate forum where a specific legal objection arises.
