First establish that the communication is genuine
A telephone call, email or messaging-app request may be genuine, incomplete or fraudulent. Preserve the message and verify the sender through an independently confirmed official channel. Do not rely only on a number or link supplied by the caller. Ask for the officer’s identity, office, case or inquiry reference and the nature of the request.
Verification should not become an excuse to disregard a real deadline. Where a formal notice has been received, provide the complete document to counsel immediately. If authenticity or wording is unclear, seek clarification promptly and retain the communication trail.
Never pay a personal account or share an OTP merely because someone claims official authority. A request for an unofficial payment should be documented and assessed separately from the underlying inquiry. The agency’s actual powers arise under law, not from a caller’s confidence. [1]
Identify who is being asked to do what
The recipient may be a company representative, witness, information custodian, suspect or person required to provide specified material. Those positions are not interchangeable. Read the actual notice before allowing management to decide that one employee can speak for everyone.
Record the requested attendance, documents or preservation step, the date range, the alleged campaign and the deadline. Check whether the notice identifies a particular statutory power or a court order. Section 31 preservation and acquisition, section 33 search and section 34 content-data disclosure involve different requirements. [1]
Where the company and an individual may have conflicting interests, arrange separate advice. A director’s desire to protect the business does not justify instructing an employee to accept responsibility for conduct they did not undertake.
Preserve relevant material immediately and proportionately
Issue a controlled preservation instruction to the people responsible for relevant email, CRM, recordings, accounts and cloud systems. Suspend routine deletion for the material concerned. Document the systems, custodians and period covered rather than collecting every employee’s private data without a reason.
Preservation is different from public disclosure or unrestricted access. Maintain the records securely while the correct production route is assessed. If data is held by a third-party platform, identify the contractual and technical means of preserving it promptly. Do not promise that the company controls data it cannot actually access. [1]
Tell staff not to delete messages, rewrite histories or coordinate answers. Remedial changes to a campaign should be separately recorded so the original position remains understandable.
Prepare a chronology that distinguishes fact from inference
Set out when the client was engaged, what service was authorised, who approved the campaign and which systems or employees were involved. Link each important statement to an actual record. Identify uncertainties honestly rather than filling them with a convenient assumption.
A useful chronology may explain that a particular employee joined after the disputed transactions, that the campaign used a different client account, or that the company only performed a defined administrative task. Those points require supporting material; job titles or unsupported denials are insufficient.
Give counsel the adverse records too. An unexpected message suggesting deception is better assessed before a response is filed than discovered after the company has made an absolute statement that no such instruction existed. The relevant PECA offence determines which facts are legally significant. [1]
Respond accurately, while addressing scope and legal protection
The response should identify the recipient, reference the notice, explain the relevant business activity and address the request in an organised way. Use an index for documents and retain a copy of what is submitted. Avoid unnecessary accusations against the complainant or speculation about the investigating officer.
Where scope, privilege, self-incrimination, confidentiality or technical capability is genuinely in issue, raise it through counsel and the appropriate procedure. Do not treat a commercial NDA as an automatic answer to a lawful request. Equally, lawful cooperation does not require volunteering unrelated customer data without considering relevance and authority. [1] [2]
If more time is needed, request it before the deadline with reasons and a realistic document-production plan. A request for extension is not approval; continue to manage the existing obligation until the authority responds.
Attendance requires preparation, not coaching
Ensure the person attending understands their own role and has access to relevant records. They should not guess, adopt another person’s recollection as their own or sign a document they have not read and understood. Request clarification or interpretation where necessary.
Legal representation and the applicable constitutional or procedural safeguards should be assessed in the actual circumstances. Do not promise that counsel may control every investigative question or that attendance can never lead to further legal action. Arrest and bail questions require their own review. [2] [3]
After attendance, record what occurred, documents supplied and any further direction. Keep the note factual. Do not publish confidential case material or customer information on social media to generate pressure.
A practical example: the wrong company name
Suppose a notice names a trading brand, while the service was performed by a separately identified company. The response should explain the relationship and provide authentic records. It should not exploit a naming ambiguity to conceal the actual operator.
If the notice concerns transactions outside the company’s service period, preserve the relevant contract and delivery dates and explain the distinction. A clear factual correction may be useful without asserting that the entire inquiry is necessarily unlawful.
The objective is a reliable record of cooperation and properly raised objections. It is not an assurance that one letter will automatically close the inquiry or remove the need for further attendance.
Legal assistance for this issue
Legal Bridge LLP can assess a notice, clarify the recipient’s legal position and prepare a fact-supported Pakistan-law response. Contact with the firm does not itself extend a deadline or establish representation.
